Liquidator will assign five skill levels

Liquidator in Ukraine appropriated five skill levels. The corresponding order, which approved the order of assignment of skill levels of arbitration managers (asset manager, managing sanitation, liquidators) signed by the Minister of Justice Oleksandr Lavrynovych.

As the wording "UP" the press-service of the Ministry of Justice, assigning skill levels will be introduced after the replacement license arbitration managers on certificate of title for the activities of arbitration managers. As is known, the change is carried out in connection with the entry into force on 19 January a new version of the Law of Ukraine "On the reconstruction of the debtor's solvency or declaring bankruptcy" (from 22.12.2011 № 4212-VI).
The first level of qualification will be awarded to all the liquidator who got in due course certificate of title for the activities of arbitration managers.

The second level of training will be assigned to the liquidator, who have been training, have worked at least three years in leadership positions and activities of which were related to the legal or economic direction of work, have experience liquidator at least three years, or exercise the powers of the property manager, sanitation manager, liquidator at least three companies.

Third level qualification may be assigned liquidator who: have experience of at least five years in leadership positions and activities of which were related to the legal or economic direction of work, have experience liquidator not less than five years, or exercise the powers of the property manager, managing sanitation, liquidator at least ten companies; have experience activities liquidator in enterprises, the number of employees over one hundred people, met at least three plans for rehabilitation or entered into a settlement agreement, and ensure complete repayment of creditors according to the register of creditors' claims in excess of 30 percent.

The fourth level qualifications may be assigned liquidator who: have experience in at least seven years in leadership positions and activities of which were related to the legal or economic direction of work, have experience liquidator not less than seven years, or exercise the powers of the property manager, managing sanitation , liquidator at least fifteen companies, have experience with the liquidator of the at least three companies, the number of employees over one hundred people, have experience in the exercise of authority trustee at least three state-owned enterprises and enterprises in which the share of the authorized capital state ownership exceeds 25-50 percent, completed at least five plans of reorganization or entered into a settlement agreement, and ensure complete repayment of creditors according to the register of creditors' claims in excess of 50 percent.

The fifth level of qualification may be granted the liquidator, who meet the requirements established by the Cabinet of Ministers of Ukraine to the arbitration administrator appointed by the court to state economic enterprises and enterprises in the authorized capital of which state ownership exceeds 50 percent. Also, corresponding to one of the following criteria: have experience of at least ten years in leadership positions and activities of which were related to the legal or economic direction of work; have experience liquidator not less than ten years, or exercise the powers of the property manager, managing sanitation, liquidator not less than twenty-five plants; have experience activities liquidator at least five companies, the number of employees over one hundred people, have experience in the exercise of authority trustee at least seven state-owned enterprises and enterprises in the authorized capital of which the share of state property exceeds 25-50 percent, completed at least seven rehabilitation plan or enter into a settlement agreement, and ensure complete repayment of creditors according to the register of creditors' claims in excess of 70 percent.

The question of attribution liquidator second - the fifth skill levels will be decided by a commission created by the Ministry of Justice in the 6 members. In particular, the commission will include three representatives from the Ministry of Justice of Ukraine, one of whom is the Chairman of the Commission, and 3 representatives of the economic courts, one of which is the Secretary of the Commission.

In the case of non-trustee declared to the commission qualification Commission may assign a lower level of qualification.
