The Verkhovna Rada has registered project of Administrative Procedural Code

Yesterday in Parliament was registered project Administrative Procedural Code of Ukraine, submitted by the Cabinet of Ministers.

The corresponding project (registration number 11472) was approved by Government on 14 November this year. Administrative and procedural code of Ukraine is designed to regulate the procedure of the relationship between man and the power to determine the legal boundaries for administration and protect the rights and legitimate interests of the person in the relationship with the state.

Code will guarantee everyone the right to a fair, honest decision of his case for a reasonable period of time. Such a right is, in particular, to include: the right to be heard before any individual decision that can affect it, the right of every person to have access to the files on it; obligations administration to justify their decisions, etc.

A separate section of the Code defines the order of execution of the administrative act, including forced.

It should be noted that in writing the Code were taken into account the principles of administrative procedure, recommended by the Committee of Ministers of the Council of Europe in the resolutions and recommendations of the Council of Europe.
