Procedures for obtaining land though the land of the state and communal combatains free to private ownership

In accordance with Part 1 paragraph 14 c. Number 12 of 3551 combatants are benefits in terms of providing primary residential area people in need improvement of living conditions and priority allocation of land for individual housing construction, horticultural, primary repair of residential homes and apartments these people and ensure her fuel. According to Art. 116 of the Land Code of citizens and legal entities acquire ownership right to use land out of state or community property upon the decision of the executive or executive government or local authorities within their powers established by this Code, namely section 12 of its transitional provisions. 

Article 121 of the Code provides that citizens of Ukraine have the right to donation of their land out of state or municipal property. According to § 6 of Art. 118 of the Land Code of citizens interested in obtaining donated the ownership of land plots from state or municipal property or farming, operating a farm, horticulture, construction c individual dwelling houses, outbuildings and structures (Croft), individual country construction, construction individual garages within the norms of free privatization, submit a request to of the district, Kyiv or Sevastopol city state administration or village, town or municipality for the location of the land.

At the request specify the destination site and its target size. The petition included graphic footage and documents to prove experience in agriculture or availability of education, obtained in the agricultural institution. According to § 7 of art. 118 of the Land Code of the application is considered within a month. In case of refusal of the executive authority or local government in the transfer of land ownership or the application would not consider resolved in court (Section 11 century. Land Code 18).
