Changing the purpose of land

Individual intends to place a shop and cafe on land granted to it for construction and maintenance of a dwelling house and outbuildings. Do change the purpose of such land and if so, how?

The concept of the purpose of land defined art. 1 of the and land use means use of land for the purpose specified in the basis of documentation of land in order to the legislation. All lands of Ukraine are divided into categories by main purpose. Within the category of land division takes place at a specific purpose. Analyzing the century. 38 of the Land Code, it can be concluded that within categories of residential and public construction land can be used
for construction and maintenance of dwellings, outbuildings, garage construction of public buildings. Paragraph 3 of Art. 20 of the Land Code provides that the change of designation of lands owned by individuals or entities is initiated by land owners in accordance with Order № 502. In Section 2 of this. Order found that changing the designation of the land land held by the submission of the application (motion) of its owner to the village, City Council if the land is located within the settlement or district administration if the land is located outside of item. The application (motion) are added:

  • copy of state certificate of title to land;
  • for the citizen - the owner of the land - a copy of passport (series, number passport, when and by whom issued and residence)
  • for a legal entity - owner of land - a copy of the statute (regulations) and a copy of the state svidotsta registration of legal persons;
  • documents to set restrictions (encumbrances) and servitudes on use of land;
  • rationale for change of use of land from indication of its size.

The decision to change the purpose of land takes appropriate local government.
